This service assists any EIC beneficiary in evaluating potential patent infringement risks across pertinent regional markets. Qualified European Patent Attorneys will thoroughly examine third-party patent rights to identify risks of conflict with the EIC beneficiary's activities. Utilising advanced patent search engines, the legal experts will methodically analyse the claim scope and specifications of existing patents compared to the EIC beneficiary's inventions. The service can be delivered online, onsite, or through a hybrid approach, depending on the client's needs. For complex innovations requiring physical examination or detailed technical discussions, and depending on the specific case (to be discussed), the European Patent Attorney can travel to the client's location. The standard delivery timeline ranges between 10-40 hours depending on the patent landscape density, complexity, and other factors. Upon completion, the service provider furnishes the beneficiary with a comprehensive digital report detailing the findings of the risk assessment. The service can be delivered through online, in-person or hybrid modalities.
Hourly rate: €350, and onsite work has an additional flat rate of €500 per day. Travel and accommodation expenses to be covered by EIC beneficiaries.
Payment terms: 60% of professional fees and 100% of official taxes and charges to be paid upfront before service commencement.
The service provider's approval of EIC beneficiaries as clients is predicated on satisfactory due diligence of creditworthiness. The service provider's risk assessment team will conduct necessary financial evaluations to ascertain the beneficiary's ability to fulfill its payment obligations under the service contract. EIC beneficiaries who successfully demonstrate creditworthiness shall be required to pay an upfront fee, consisting of 60% of the professional fees and 100% of the official taxes and charges, before the commencement of services. This upfront fee payment serves as a provision to initiate work on the file. Once the upfront fee has been settled, beneficiaries shall be onboarded as clients and services will commence accordingly.
