Service description

This service provides professional assistance for any EIC beneficiary seeking to obtain trademark protection, either nationally – in Romania - the Romanian Patent Office (OSIM) or at the level of the European Union – the European Union Intellectual Property Office (EUIPO) or international applications filed with WIPO (World Intellectual Property Organization). It includes but is not limited the following type of services of counselling ans representation: 
i)  filing a national trademark application and prosecuting it until grant;
ii) filing a European  trademark application and prosecuting it until grant; 
iii) filing an International application (Madrid Protocol/Agreement); 
iv) opposition procedures in Romania against Client’s trademarks or oppositions filed by Client against third parties’ application, including further stages (appeal); 
v)  opposition procedures at the level of the European Union – the European Union Intellectual Property Office (EUIPO) against Client’s trademarks or oppositions filed by Client against third parties’ application, including further stages (appeal); 
vi) Court proceedings in Romania for trademark matters including but not limiting to invalidation and all enforcement procedures; 
vii) representation in Romania for Customs enforcement for the protection of trademark rights; 
viii) prosecuting the International application in other countries by instructing local agents in case of refusals or oppositions against Client’s International Trademark.

Financial requirements

Hourly rate: €250 - €350.

Payment terms: 50% of the estimated minimum professional fees to be paid upfront before service commencement, the remainder of the value of the professional fees to be paid upon completion of the stage. 100% of official taxes for each stage must paid to the respective office before each stage submission with the respective office. We prefer that the beneficiaries pay directly the official taxes to the respective office, based on a calculation made by us.

Disclaimer related to service

The service provider's approval of EIC beneficiaries as clients depends on the potential client's creditworthiness. EIC beneficiaries who successfully demonstrate creditworthiness shall be required to pay a retainer fee mentioned above, before the commencement of services. This retainer fee serves as a provision to initiate work on the file. Once the upfront fee has been settled, EIC beneficiaries shall be onboarded as clients and services will commence accordingly. Payment of the official taxes is included in the condition above.
