Freedom to Operate Analysis

Service description
Freedom to Operate (FTO) Analysis is an individualised intellectual property service for EIC beneficiaries seeking to assess potential patent-related obstacles to commercialising a defined product or technology in selected countries or markets.
Based on technical information and product specifications provided by the beneficiary, patent experts conduct targeted patent searches and analyse identified patent rights that may be relevant to the planned commercial activities. The analysis covers granted patents that are in force and patents in the grant phase. Pending patent applications are not included, as their eventual scope and grant are not yet certain.
For European countries, the search covers European Patent (EP) patents and relevant national patents available through the databases used for the analysis. Relevant non-English publications are assessed using available translations.
The service typically takes 2–3 weeks from receipt of sufficient technical information and product specifications. It consists of defining the scope and target markets, conducting patent searches, analysing potentially relevant patent rights, and reporting the findings.
The beneficiary receives a list of identified patent documents and an analysis of relevant findings to support informed decisions regarding product development, commercialisation and market entry. Upon request, a statement confirming that an FTO study has been conducted can also be provided.
The service is tailored to the beneficiary’s technology, product and intended geographical markets. Additional analysis outside the agreed scope can be provided separately.
All services provided by Moosedog Oy are subject to Moosedog Oy’s General Terms and Conditions. The beneficiary is responsible for providing accurate and timely information and instructions and for observing applicable deadlines. Moosedog Oy’s liability is limited to verified direct damages up to a maximum of EUR 250,000 and excludes indirect damages. Finnish law applies. By accepting Moosedog Oy’s quotation, the beneficiary accepts the applicable General Terms and Conditions.
