Service description

This service targets any EIC beneficiary looking to understand if they are infringing any third party’s patent rights. The service covers different markets / regions. The analysis will be performed by qualified European Patent Attorneys using high-end patent search engines such as Questel Orbit. The estimated duration of the service is about 10 - 40 hours per complete risk assessment (depending on the amount of relevant third party rights, complexity, saturation of the market/patent field etc.) and can be implemented online, offline or hybrid. A digital report will be delivered to the EIC beneficiary (client) at the end of the service.

Acceptance of beneficiary as a client will be based on creditworthiness of EIC beneficiary. The provided assessment provides an overview of relevant third party rights “out there” and enables an EIC beneficiary to assess certain risks and threats and make educated, information-driven, choices in business. A PIRA is not to be regarded as a freedom-to-operate (FTO) guarantee. Neither does a PIRA provide a undisputable guarantee that a third party right is infringed on (or not); for example, a national judge may still decide otherwise.
